Course overview

The Government has now published guidance about the new offence of failure to prevent fraud, which comes into force on 1st September 2025. Introduced as part of The Economic Crime and Corporate Transparency Act, the changes also mean that criminal acts committed by a company officer can more easily be attributed to the company itself.

This two-hour course will introduce you to the concept of 'failure to prevent' (FTP) and explain the new FTP offences and who they apply to. It will discuss the impact of recent changes to the law, how to meet your legal responsibilities and how to establish reasonable prevention procedures.

What will you learn?

The course will answer the following questions.

  • What is 'failure to prevent'?
  • What are the FTP offences?
  • What is the significance of the 'identification doctrine'?
  • What is an 'associated person'?
  • What are the penalties for getting it wrong?
  • What are the responsibilities of a company director or senior manager?
  • How do you train my staff effectively?
  • What policies, controls and procedures do I need to introduce?
  • What are the six guiding principles to financial crime risk management?
  • How often are FTP offences prosecuted?
